License to Use Content: Clients are granted a non-exclusive, non-transferable license to use the deliverables provided by Mohcky Agency solely for the purpose intended under the project agreement. You are not permitted to resell, redistribute, or reuse these materials for any purpose other than that which was initially agreed upon without prior written consent from us.
- Limitation of Liability
Mohcky Agency provides digital marketing services to the best of our ability, but we do not guarantee specific results, such as a certain ranking in search engines, a set amount of website traffic, or a particular conversion rate. Digital marketing is influenced by numerous factors beyond our control, including changes to algorithms, market trends, and competitors.
In no event will Mohcky Agency be liable for indirect, incidental, special, or consequential damages, including but not limited to lost profits, lost data, or business interruptions, even if we were advised of the possibility of such damages. Our liability is limited to the total amount paid by the client for the services in question.
- Termination of Services
Either party may terminate the agreement by providing written notice to the other party. Termination may occur if there is a material breach of these Terms, or if the client fails to meet payment deadlines.
Client’s Right to Terminate: If you decide to terminate the agreement before the completion of the project, you may be required to pay for the services rendered up to that point. Any work completed will be delivered to you, but we reserve the right to withhold any unfinished deliverables.
Mohcky Agency’s Right to Terminate: If payment is not received on time or if the client fails to provide necessary feedback or information in a timely manner, we reserve the right to suspend or terminate services. We will notify you if such a situation arises.
- Dispute Resolution
In the event of a dispute, we encourage the parties to resolve the matter amicably. If informal negotiations fail, we agree to attempt mediation before pursuing legal action. Any legal proceedings or claims related to these Terms will be governed by the laws of India and will be handled in the courts located in Delhi, India.
